Course Overview

ICCouncil's DER Training help employers, supervisors, and Designated Employer Representatives with essential skills to manage DOT Drug and Alcohol Testing Programs under 49 CFR Part 382 and Part 40. This course covers the DER's legal role, federal regulations, CDL Clearinghouse obligations, step-by-step testing procedures, consequences of violations, employer recordkeeping requirements and all six required testing types. After completing this course, you will be fully prepared to run a compliant DOT drug and alcohol program and protect your organization from costly federal penalties.

What will I learn?

How to define the DER role, authority, and legal responsibilities that cannot be delegated to any service agent.
Federal regulations under 49 CFR Part 382 and Part 40, including who must comply and which CDL drivers are covered
How to register and use the FMCSA CDL Drug and Alcohol Clearinghouse for pre-hire queries and annual driver checks.
Pre-employment and random testing requirements including minimum annual rates and unannounced driver selection process.
Post-accident and reasonable suspicion testing along with qualifying criteria, timelines, and supervisor training requirements.
Return-to-duty and follow-up testing after a violation, including SAP evaluation and directly observed collection
The five DOT-tested drug classes, alcohol BAC thresholds, and specific employer actions required at each threshold.
Step-by-step DOT urine collection and breath alcohol procedures, including chain of custody and MRO result verification.
Learn the way to handle failed and refused tests.

We cover the DER's authority under DOT regulations — receiving drug and alcohol results, taking immediate action, coordinating with all service agents including MROs, SAPs, and collection sites, and maintaining all required federal records. You will understand why the DER role carries full legal accountability that cannot be transferred or delegated to any other party whatsoever.
